The EU is banning nudifier AI apps: what changes in December and what it means for adult content creators

From December, the EU will offer stronger protection to people depicted in manipulated intimate content without consent

A new European Union rule targets intimate content created or manipulated without consent. This includes tools commonly known as “undressing” or nudifier apps when they generate deceptively realistic images, videos or audio recordings of a real person.

2 December 2026 will be an important date, but this does not mean that all AI-generated adult content will become prohibited. The decisive factors are whether a person is recognisable, whether the content is realistic and whether explicit consent was given.

Regulation (EU) 2026/1744, published in the Official Journal of the European Union on 24 July 2026, supplements the prohibited practices under the AI Act. The regulation entered into force on 27 July 2026, while the new prohibition concerning intimate content will start to apply in December.

What exactly does the new rule prohibit?

The rules target realistic images, videos, audio recordings and similar content. They apply in particular when the intimate parts or sexually explicit activity of an identifiable person are depicted without that person’s free, specific, informed and unambiguous consent.

Responsibility may extend beyond the person who creates the content. The provider of the AI system may also be affected if the product was designed for such abuse, or if the risk is foreseeable and repeatable but appropriate safeguards have not been implemented.

• The provider of the AI system may fall within the scope of responsibility if it fails to prevent foreseeable abuse.
• The user of the AI system may be affected if the tool is deliberately used to create or manipulate intimate content without consent.

The regulation also specifically prohibits the generation and manipulation of partly or fully artificial content depicting the sexual abuse of children. In such cases, it does not matter whether the source material was originally real or artificial.

What may remain permitted?

The new rule is not a general moral prohibition and does not automatically make all AI-generated nude or adult content unlawful. Its purpose is to curb abuse involving identity and consent.

Different treatment may apply, for example, to a completely fictional and unidentifiable adult character, or to material for which the adult depicted gave prior and demonstrable consent. The same may apply to imagery that is not realistic, is clearly illustrated or depicts physically impossible scenes.

The decisive issue is not the use of AI, but whether a real person is recognisable and gave clear permission.

What does this mean for adult content creators?

In professional adult content production, documenting consent and the origin of content will become even more important. For an AI-modified image or video, it will not be enough simply to state that the final material was created artificially.

Content creators, agencies and platforms should maintain a transparent process. It should be clear who appears or can be recognised in the content, what uses they authorised, whether the face, body, voice or video was manipulated, and how withdrawn consent or reports are handled.

• Was any AI-based modification made?
• What reporting and removal process is in place?

From December, providers will also need to take more active precautions

The regulation does not apply only to applications developed specifically for harmful purposes. The provider of a general image-generation system may also fall within the scope of responsibility if abuse is foreseeable and repeatable but reasonable protective measures are not used.

Such protection may include cleaning training data, detecting prohibited requests, filtering outputs, restricting use, detecting abuse, and providing reporting and removal options. The law does not prescribe one technical solution. It expects safeguards to match the system and its real risks.

There is no safe shortcut without consent. AI does not remove responsibility connected to a real person.
