The debate flares up again in Romania: should sex jobs be regulated, or would legalisation set a dangerous precedent?

The issue of prostitution has returned to the forefront of Romanian public life after a representative of one of the parties in the governing coalition submitted a bill for the legalisation of sex jobs and their strict regulation. The initiative immediately split political actors, civil society, and the Church.

The topic is not without precedent in Romania, but all similar attempts have failed so far.

Tackling a “difficult topic”

The proposal was submitted by Ion Iordache, an MP of the National Liberal Party. In his own words, he does not wish to popularise prostitution, but to remove it from the legal and social grey zone.

He argues that in Romania adult jobs and sexual services already exist, but largely operate without regulation: without health checks and legal protection, often under the control of human trafficking networks.

Iordache stated that the lack of regulation is hypocritical, while the state has a duty to act against modern slavery and protect the health and safety of those involved.

What would the bill contain?

The submitted proposal would introduce a licensed, strictly controlled form of prostitution. According to the draft:

  • only adults working voluntarily could perform sex jobs,
  • regular health checks would be mandatory,
  • human trafficking and exploitation would be severely punished,
  • services would be restricted at a set distance from schools, parks and churches,
  • the practice of erotic activities would require official approval.
According to the MP, the goal is not to bring more people into the sex industry, but to ensure that those already in it are not at the mercy of criminal networks.



Citing European examples

In his argument, Iordache cited several European countries as examples, including Germany, the Netherlands, Austria and Switzerland. In these countries, prostitution operates legally within regulated frameworks.

He believes these countries have recognised that only legal instruments can curb human trafficking, not a total ban.

However, he gave an evasive answer when asked whether he had consulted his party leadership and the prime minister before submitting the draft. He said he had discussed the topic with several political colleagues, civil society organisations and church representatives.

Political fault lines within the coalition

Although a social democratic MP also supported the bill with their signature, the first serious resistance came from within the party itself, Telex reports.

According to MP Diana Tușa, the fight against human trafficking does not run through the legalisation of prostitution. In her view, improving education and creating jobs would provide the real solution.

She claims that the experiences of other countries do not prove that legalisation reduces human trafficking; at most, it changes its form and locations.

Firm rejection by the Church

The Romanian Orthodox Church condemned the initiative in a statement. In its view, adult jobs are not compatible with human dignity and social values.

The Church also pointed out that Romania has signed a UN convention which states that prostitution endangers the well-being of the individual, the family and the community.

Creating legal frameworks does not eliminate exploitation; it may give it room to grow.

According to the Orthodox Church, legalisation would not eliminate either illegal prostitution or human trafficking.

In Romania, the idea of regulating prostitution has arisen before. In 2007, two ministers supported the idea, citing economic arguments, including the potential for GDP growth.

In 2010, a new initiative emerged, which was eventually rejected by both houses of parliament, partly due to pressure from the Church.

Since 2014, prostitution has been decriminalised in Romania: the sex job itself is not a crime, but facilitating it is, and there are penalties for soliciting in public.

There is no unified approach in Europe. In ten countries, prostitution is legal and regulated, and the system is nevertheless still characterised by legal uncertainty.

In other states - for example Sweden, Norway, France or Ireland - the client is punished, meaning paying for sex is illegal.

At the same time, a significant number of Romanian citizens work in the Western European sex market, often in vulnerable conditions.
