There is a war in Ukraine, but porn jobs and erotic jobs continue to flourish

The Russian-Ukrainian war certainly won't stop porn jobs, they're actually just hitting it off!

How are porn jobs and OnlyFans jobs currently regulated in Ukraine, what do the representatives propose in the legislation, and what benefits would the decriminalization of adult content bring to the country? These are all questions that have recently arisen in the Ukrainian parliament regarding the sharing of pornographic content and erotic jobs.

Thousands of Ukrainians earn money by making porn movies and erotic images, and some even raise donations for the army by producing erotic content.

"Currently, the storage or distribution of sensitive, even personal, erotic photos and videos can be considered a crime. The topic of pornography is considered one of the biggest taboos in Ukrainian society," we can read in an article by Ekonomicheskaya Pravda.

Currently, porn jobs and distributing porn is a crime in Ukraine.

Four articles of the criminal code deal with pornography

For example, according to Article 301 of the Criminal Code, it is already punishable if someone stores nude photos of themselves on their phone. This can be construed as a criminal offense with all relevant consequences.

The main question revolves around the term " with intent to distribute".

Even sending an erotic photo to your girlfriend, wife or boyfriend is considered distribution.

The problem is that Article 301 of the Criminal Code does not define the concept of pornography.

This was included in the law on the protection of public morals, which was in force until March 31, 2023.

How does the law define pornography?

Under this law, pornography is the recording of sexual acts that are vulgar, naturalistic, cynical, obscene, self-serving, with special presentation of the genitals, unethical scenes of sexual intercourse, sexual perversions, inappropriate to moral criteria, insulting the honor and dignity of the person, scenes arousing undignified instincts.

However, even this definition leaves a lot of room for interpretation as to what is considered porn and what is not.

The law does not explain what unethical scenes, sexual perversions, moral criteria or undignified instincts mean.

What are the penalties for sharing pornographic content and having a porn job?

Prosecution under Article 301, i.e. the production and trade of non-child pornography, is punishable by fines, restrictions, or imprisonment. Producing or distributing pornographic images is punishable by a fine of up to 68,000 hryvnias or imprisonment of up to three years.

Producing or distributing pornographic videos or distributing pornographic materials aimed at minors is punishable by a fine of up to 85,000 hryvnias or imprisonment of up to five years.

• Gaining access to child pornography is punishable by up to 6 years in prison.
• Importing and distributing this content can result in 7-10 years in prison.
• Producing, selling, or forcing minors to participate in the production of child pornography is punishable by imprisonment of up to 8-12 years.
• Holding a spectacular sexual event with the participation of minors is punishable by imprisonment of up to 5-7 years.
• A fine of up to 34,000 hryvnias or imprisonment of up to five years is the punishment for operating a location for prostitution.

What constitutes a crime when it comes to porn jobs?

"Crimes" within the scope of Article 301 offer a wide range of interpretations to the police and the courts.

According to this article, even those who simply send personal erotic videos or photos through messaging apps can be punished.

As a specific case, we can mention the decision of the Poltava court in July, which involved a girl who sent two " sensitive videos" to her boyfriend.

The court considered that such activities violate the basic principles of public morality, the system of ethical norms, and are contrary to the spiritual and cultural values ​​traditionally formed in society, as well as to the norms of behavior, such as goodness, honor, dignity, social duty, the ideas of conscience and justice.

The girl was sentenced to a fine of 34,000 hryvnias for the violation established by the court.

This punishment is one of the sanctions against persons convicted by the legal system, with which the authorities try to maintain social norms and values, regulating erotic jobs.

Another incident involved a man who shared images and videos on a sex-dating website that "captured his naked genitals from a close-up perspective in a vulgarly naturalistic and obscene manner."

The judicial investigation showed that it was pornography.

The Sumy district court sentenced the man to three years in prison (with a one-year probationary period) and deprived him of his right to hold jobs related to the IT sector.

In Ukraine, hundreds of proceedings are initiated yearly based on Article 301 of the Criminal Code, the vast majority of which are related to the cases mentioned above.

Pornhub and Onlyfans jobs are also becoming more and more popular in the eastern neighbor

Ukraine, despite several convictions for criminal proceedings and the distribution of pornographic content, remains an active participant in the global porn market on both the demand and supply sides.

In 2022, Ukraine was the 15th largest country in Pornhub's world ranking, one of the largest porn sites in terms of data traffic.

Despite the heavy war and the occupation of part of its territory, Ukraine fell only two places in one year.

On average, Ukrainian users spend almost ten minutes on Pornhub, 50% of them are 18-34 years old, 23% are 35-44 years old, and 27% are over 44 years old.

41 percent of Ukrainian visitors to the site in 2022 were women.

In addition, Ukrainians actively use the Onlyfans platform

OnlyFans charges users to access content created by OnlyFans models and has become popular for adult entertainment and erotic content.

A content creator's subscriber can view their content for a monthly membership fee, where 80% of the fees go to the content creator and 20% to the platform.

The popularity of OnlyFans among Ukrainians is shown by the fact that in the first six months of the year, the company paid 34 million hryvnias of VAT to the Ukrainian budget.

Ukrainians don't just consume porn, they also actively create such content with porn jobs.

In addition, they also produce adult content to support the national defense forces.

Also, last March, two users of the OnlyFans platform founded the Theronlifes movement.

The members of the movement exchange the donations paid into the account of one of the charities for erotic photos.

At the beginning of August, they managed to collect about 31.48 million hryvnias.

The European Parliament called on OnlyFans to provide statistics on the number of users in Ukraine and their income from their sexy job.

However, the platform refused to publish such information, stressing that it does not categorize content creators, especially not based on their place of residence.

200,000 Ukrainians have Onlyfans jobs on the platform

Roughly 500 million people worldwide use the Onlyfans platform, according to rough estimates, of which 2.1 million are content creators.

Each content creator has an average of 21 subscribers and earns an average of $180 per month.

At the same time, more than 300 content creators earn more than a million dollars a year on the platform.

According to Guy De Smet, the Eastern European regional manager of the CAM4 webcam platform, more than 200,000 Ukrainian erotic models may publish pornographic content on OnlyFans.

If we assume that each of them earns $180 per month, the market turnover can reach 15.8 billion hryvnias per year from OnlyFans jobs alone.

Onlyfans is a relatively new platform, but its emergence has already led to an increase in criminal cases related to porn jobs, lawyers say.

In Ukraine, the production and distribution of pornography through more traditional websites is still underdeveloped.

Professional porn actors in Ukraine usually work in foreign studios, where the laws regarding the distribution of such erotic content are not so strict.
