For years, cash fines imposed for prostitution have been piling up in several Romanian cities, yet for local authorities their collection is practically impossible. The system punishes, but in practice no money comes in, nor is any real solution found for adult jobs.

The figures speak for themselves: in Arad, roughly 3 million lei in fines have accumulated for about thirty individuals, amounting to more than €500,000.

Six-figure debts, repeated fines for prostitution

These are cumulative sanctions. One woman received penalties on several hundred occasions, totalling 243,000 lei. Another two sex workers each racked up fines exceeding 200,000 lei.

Meanwhile, individual administrative fines range between 500 and 1,500 lei, and most often the minimum amount is imposed. The debt therefore does not stem from a single large fine, but from repeated, regular sanctions, Maszol reported.

According to municipal offices, the biggest problem is that the majority of those concerned do not have registered employment, nor do they own property, cars or other seizable assets.

Many are not locals either, but come from other settlements. Thus, enforcement proceedings are extremely cumbersome and often ineffective.

Courts often order community service instead of a cash fine, but experience shows that this is not fulfilled in every case either.

Adult jobs represent a concrete means of livelihood for many, so proper and transparent regulation would be important.

Similar situation for adult work in Oradea

In Oradea the issue is smaller in scale but similar: for 15 individuals, fines totalling about 305,000 lei have accumulated.

According to the head of the local economic department, the police are aware that prostitution fines will not be paid anyway, so they do not impose sanctions with excessive severity.

The municipality seeks to avoid distortions in financial statements by not allowing debts to accumulate for years, instead applying insolvency proceedings for amounts that are in reality uncollectable.

Drobeta Turnu Severin: six million

According to an Antena 3 CNN report, in Drobeta Turnu Severin more than 6 million lei in total fines have been amassed over the years.

Some sanctions even date back to 1992 - despite the fact that in Romania prostitution was only decriminalised in 2014. In one person’s case, the accumulated fines have already reached 1 million lei.

Since the individuals concerned have no enforceable assets, compulsory enforcement is practically a dead end.

Regulation instead of punishment?

The situation is particularly interesting in light of the fact that a National Liberal MP recently submitted a bill to legalise prostitution. According to the proposal, sex work would become a regulated and taxable activity.

The current practice reveals a peculiar contradiction: prostitution is decriminalised, yet administrative offences linked to it lead to million-lei fines that ultimately cannot be collected.

The system punishes, but the money never arrives - and the problem is not resolved.

Adult jobs in the grey zone

The Romanian example clearly shows the consequences when the regulation of prostitution goes awry. Fines keep piling up, municipal paperwork increases, while the situation of sex workers is neither more orderly nor safer.

Thus neither human trafficking, nor exploitation, nor public health issues receive a real answer. The question is not really how to punish, but how to handle an existing phenomenon so that it results in less harm and more workable solutions.
